Welcome to FitNSet
Welcome to FitNSet ("the App," "we," "our," or "us"). By downloading, accessing, or using FitNSet, you ("you," "user," or "member") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.
1. Eligibility
You must be at least 16 years old to use FitNSet.
If you are under 18, you must have permission from a parent or legal guardian.
By using the App, you represent that you have the legal capacity to enter into these Terms.
2. Accounts
Account Creation
You are responsible for creating and maintaining an accurate account with truthful information.
Security
Keep your login credentials confidential; you are responsible for all activities under your account.
Account Suspension
We may suspend or terminate accounts that violate these Terms or engage in inappropriate behavior.
Account Recovery
Contact support immediately if you suspect unauthorized access to your account.
3. Use of the App
What We Provide
FitNSet provides workout tracking, calorie logging, fitness plans, and related features to help you achieve your fitness goals.
Prohibited Activities
You agree not to misuse the App (e.g., hacking, scraping, reverse engineering, or spamming).
You may not use the App for unlawful purposes or to harm others.
Sharing inappropriate content or harassing other users is strictly prohibited.
4. Health Disclaimer
Important Health Notice
FitNSet is not a medical service and does not provide medical advice. Always consult a qualified healthcare professional before starting any exercise, diet, or fitness program.
By using the App, you acknowledge that physical activities carry risks and that you participate at your own risk.
We are not liable for any injuries, health problems, or losses resulting from your use of the App.
Stop exercising immediately if you experience pain, dizziness, or other concerning symptoms.
5. Payments & Subscriptions
Premium Features
Some features may require paid subscriptions or in-app purchases. All fees, billing cycles, and renewal terms will be clearly disclosed at purchase.
Payment Processing
Payments are processed by third-party providers (Google Play, Apple App Store). We do not store your payment details on our servers.
Auto-Renewal
Subscriptions will auto-renew unless canceled in your app store account settings before the renewal date.
Price Changes
We may change subscription prices with 30 days notice. Price changes will not affect your current billing cycle.
6. Refunds
All payments are generally non-refundable, except as required by applicable law or at our discretion.
For subscription issues, you may need to contact your app store provider (Google Play or Apple App Store).
We may offer refunds in cases of technical issues or billing errors on our part.
7. Intellectual Property
Our Rights
All content, trademarks, and features in FitNSet are owned by us or licensed to us. You may not copy, modify, distribute, or exploit any part of the App without permission.
Your Content
User-generated content (workout logs, chat messages, uploaded data) remains yours, but you grant us a license to use it to operate and improve the App.
8. Third-Party Services
The App may integrate with third-party platforms (e.g., payment gateways, health data services, messaging apps).
We are not responsible for third-party services, and their terms of use and privacy policies will apply to your use of those services.
9. Termination
You may stop using the App at any time by deleting your account or uninstalling the app.
We may suspend or terminate your access if you violate these Terms or misuse the App.
Termination does not relieve you of payment obligations for subscriptions already charged.
10. Limitation of Liability
To the fullest extent permitted by law, we are not liable for damages, including but not limited to:
Personal injury or health problems
Lost profits or business interruption
Data loss or corruption
Indirect, incidental, or consequential damages
11. Indemnification
You agree to indemnify and hold FitNSet harmless against claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
12. Changes to Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements.
Continued use of the App after changes means you accept the revised Terms.
We will notify you of significant changes through the app or email.
13. Governing Law
These Terms shall be governed by and construed under the laws of India (unless you specify another jurisdiction).
Disputes will be resolved in the courts of Bangalore, India.
